A family, long-time residents of Oak Park Manor apartments, experienced an unexpected and distressing situation. Living there without any rental issues, the family found themselves receiving eviction notices that were not meant for them.
The mother of the family, Erica Montgomery, was naturally worried about receiving notices at her door addressed to her but referring to someone else. Despite bringing it to the attention of the leasing office, who confirmed it was a mistake, there seemed to be a clear lack of effective communication which resulted in confusion and distress.
Montgomery shared her concerns again when a letter arrived on August 6th instructing her to move out within 24 hours. Again, she was reassured that the eviction was meant for someone else, and she left for a vacation with her family. Unbeknown to them, an eviction was carried out whilst they were away.
Speaking about the stressful incident, Montgomery said, “They (apartment management) called me and said we apologize, but they did put your stuff out. They noticed midway and brought all the stuff back in.”
To add to the confusion, the court involved in the eviction explained that it had not been informed about the incorrect address present on the original summon and complaint document. This lack of information ultimately led to the eviction order being carried out at the wrong address. The court officer only realized the error halfway through, putting a halt to the eviction.
The origin of this blunder appears to be a mistake in the paperwork filed by the apartment complex’s attorney. The court has since asked for a written explanation from the attorney but as of now, there is no further information available.
The apartment complex management has chosen not to comment on the situation. Hence, one big question remains unanswered for the distressed family: Who will be held accountable for their missing and damaged belongings?
As the situation unfolds, many are left questioning the procedure and thorough verification carried out before drastic measures like an eviction are enforced. This situation has put the spotlight on the need for clear and effective communication and verification to prevent such stressful incidents from happening in the future.
